Kashmir Govt. appoints Commission to probe fake encounters.

Jammu April 02, 2007 (Kashmir Newz Desk) :---

The Jammu and Kashmir government has appointed an Inquiry Commission to look into the instances of fake encounters and custodial killings in the region.

The Commission would be headed by Justice M L Koul, a retired High Court judge.

The constitution of the Commission was on the cards after the recent expose of fake encounters in which innocent civilians were picked up from streets, dubbed as militants and killed in staged encounters.

The Commission has also been asked to present its report to the government within three months.

The Law Department issued an SRO in this regard according to which “the government is of the opinion that it is necessary to appoint a Commission of Inquiry to enquire into a definite matter of public importance, namely the recent alleged custodial killings and fake encounter, resulting in the death of some people like Abdul Rehman Padder of Kokernag in south Kashmir.

The Commission of Inquiry was constituted in exercise of the powers conferred by section 3 of the Jammu and Kashmir Commission of Inquiry Act, 1962.

The Commission would enquire into the causes, circumstances and conspiracy, which led to the death of persons in alleged custodial killings and fake encounters.

It would also fix the responsibility of the persons involved in these killings and make recommendations for preventing recurrence of such incidents in future.

The Commission shall perform all the functions necessary for holding the enquiry or incidental thereto and submit its report to the government within a period of three months.”
